1. Definitions

For the purposes of these Terms and Conditions:

• “Company,” “We,” “Our,” and “Us” refer to Clean Curb, LLC.

• “You” and “Your” refer to the user, visitor, or customer of our website and/or services.

• “Services” refers to the curbside garbage bin, recycling bin, and yard/compost container cleaning, sanitizing, and deodorizing services provided by Clean Curb, LLC.

• “Agreement” refers to these Terms and Conditions in their entirety.

2. Intellectual Property Rights

Other than content you own, under these Terms, Clean Curb, LLC and/or its licensors own all the intellectual property rights and materials contained in this website, including but not limited to text, graphics, logos, images, audio clips, and software. You are granted a limited license only for purposes of viewing the material contained on this website and for scheduling our Services.

3. Service Terms and Customer Responsibilities

By scheduling Services with Clean Curb, LLC, you agree to the following:

• Next-Day Service: Our Services are performed the day after your regularly scheduled municipal garbage collection. You are responsible for ensuring your bins remain curbside and accessible until 6:00 PM on the day of your scheduled cleaning.

• Empty Bins Required: All containers must be empty of garbage, recycling, yard waste, and any other debris prior to our arrival. If we arrive and a bin is not empty, you may still be charged for the scheduled visit.

• Prohibited Substances: Containers must not contain hazardous materials, chemicals, medical waste, or any substances that may pose a risk to our technicians or equipment. Clean Curb, LLC reserves the right to refuse service on any container containing prohibited substances, and the customer will still be charged for the visit.

• Bin Identification: For monthly and quarterly subscribers, Clean Curb, LLC may affix an identification label to your containers to ensure proper service on future visits.

• Service Completion Notification: Upon completion of your cleaning, Clean Curb, LLC will send you a text message notification. Your containers will be returned to your curbside or desired storage location located on the exterior of the property, as specified during registration.

• Missed Service: If Clean Curb, LLC fails to perform the scheduled service for a reason other than your failure to meet the above responsibilities, we will, at our sole discretion, either arrange to perform the service on during the next available service day or credit your account for the missed visit.

4. Restrictions

You are specifically restricted from all of the following:

• Publishing any website material in any other media without prior written consent from Clean Curb, LLC;

• Selling, sublicensing, and/or otherwise commercializing any website material;

• Publicly performing and/or showing any website material;

• Using this website in any way that is or may be damaging to this website or to Clean Curb, LLC;

• Using this website contrary to applicable laws and regulations, or in any way that may cause harm to persons, property, or the environment.

5. Payment Terms

Payment for Clean Curb, LLC Services is due in accordance with the billing cycle you selected at sign-up. By providing your credit or debit card information, you authorize Clean Curb, LLC to charge your designated payment method on your agreed schedule.

• Monthly subscriptions require a minimum commitment of four (4) cleanings. If you cancel before four (4) cleanings have been completed, the remaining balance owed for the four-cleaning minimum will be charged to your payment method on file

• Quarterly subscriptions require a minimum commitment of three (3.) cleanings. If you cancel before three (3) cleanings have been completed, the remaining balance owed for the three-cleaning minimum will be charged to your payment method on file.

• Clean Curb, LLC may exempt a customer from the minimum commitment, in its sole discretion, in the event services are not provided and we are unable to reasonably correct the issue.

• If your payment is declined or not honored by your card issuer, you agree to pay all amounts due upon demand.

• Clean Curb, LLC reserves the right to modify pricing at any time. Any changes in pricing will be communicated to you via telephone, SMS, mail, or email. Continued use of our Services after receiving such notice constitutes acceptance of the updated pricing.

• You must promptly notify Clean Curb, LLC of any changes to your payment method, including changes to account numbers, expiration dates, or cancellation of the card.

• Clean Curb, LLC reserves the right to suspend or terminate your service without notice upon rejection of any credit or debit card charges.

6. Your Content

In these Terms and Conditions, "Your Content" means any audio, video, text, images, or other material you choose to display on this website (e.g., in reviews or testimonials). You grant to Clean Curb, LLC a non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate, and distribute Your Content in any and all media for purposes related to our business. You represent and warrant that Your Content does not infringe on any third-party rights and that you have all necessary permissions to grant this license.

7. Environmental & Eco-Friendly Practices

Clean Curb, LLC is committed to environmentally responsible service. Our cleaning trucks are designed to capture solid waste residue and wastewater from the interior bin cleaning process. All collected wastewater and solid waste residue is treated and disposed of in compliance with the terms of our Mobile Washer Permit issued by the Central Contra Costa Sanitary District. We use no harsh chemicals in our cleaning process — only pressurized hot water and EPA-approved, household cleaning solution.

8. No Warranties

This website is provided "as is," with all faults. Clean Curb, LLC expressly disclaims all representations and warranties of any kind related to this website or the materials contained on it, whether express, implied, or statutory, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Clean Curb, LLC does not warrant that the website will be error-free, uninterrupted, or free of viruses or other harmful components.

9. Limitation of Liability

In no event shall Clean Curb, LLC, nor any of its officers, directors, employees, or agents, be held liable for anything arising out of or in any way connected with your use of this website or our Services, whether based on contract, tort, strict liability, or any other legal theory, even if Clean Curb, LLC has been advised of the possibility of such damages. This includes, without limitation, any direct, indirect, incidental, punitive, and consequential damages. Some jurisdictions do not allow the exclusion or limitation of liability for certain damages; in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

10. Indemnification

You hereby agree to indemnify, defend, and hold harmless Clean Curb, LLC and its officers, directors, employees, and agents to the fullest extent permitted by law from and against any and all liabilities, costs, demands, causes of action, damages, and expenses (including reasonable attorneys’ fees) arising in any way related to: (a) your breach of any provision of these Terms; (b) your use or misuse of this website or our Services; or (c) your violation of any applicable law or the rights of any third party.

11. Cancellation & Termination

You may cancel your recurring Service subscription at any time, provided that notice is received before the next billing date. If the minimum service commitment has not been reached for monthly or quarterly subscriptions at the time of cancellation, the remaining balance owed for the minimum service commitment is due. Cancellations may be submitted via email at the contact address listed below. Clean Curb, LLC reserves the right to terminate or suspend your account and access to our Services at any time, for any reason, including but not limited to a breach of these Terms or non-payment.

12. Variation of Terms

Clean Curb, LLC is permitted to revise these Terms and Conditions at any time as it sees fit. Changes will be effective immediately upon posting to this website, and/or upon notification to you via email, SMS, or mail. By continuing to use this website or our Services after any such revisions, you agree to be bound by the updated Terms. You are expected to review these Terms on a regular basis to stay informed of any changes.

13. Governing Law & Severability

These Terms and Conditions shall be governed by and construed in accordance with the laws of the state in which Clean Curb, LLC operates, without regard to its conflict of law provisions.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
